Michael K. Twersky is a partner in the Litigation Department at Montgomery, McCracken, Walker & Rhoads, LLP where his practice focuses on commercial litigation, First Amendment matters and criminal cases and investigations. He has represented many diverse clients including Fox Television, The University of Pennsylvania, Baby Loves Disco, LLC and Financial Services Center of Pennsylvania.
Mr. Twersky has handled a wide variety of complex commercial cases, including securities fraud class actions, trademark infringement matters and complicated contractual disputes. He also has represented television stations, newspapers, Internet companies and individuals in defamation cases in federal and state courts. In addition, Mr. Twersky has represented clients in state and federal criminal matters, including the representation of officers and crew members in connection with environmental crimes occurring on marine vessels.
In 2003, Mr. Twersky represented a group of private schools, parents and a public high school student in successfully challenging the constitutionality of a Pennsylvania law that affected all students and private schools in the Commonwealth. Mr. Twersky also successfully argued the appeal of that case, The Circle School, et al. v. The Honorable Vicki Phillips, et al., before the United States Court of Appeals for the Third Circuit.
In 2006, Mr. Twersky again appeared before the Third Circuit in a First Amendment case involving free speech rights on the Internet and the Federal Communications Decency Act. The Third Circuit upheld the lower court's dismissal of the Complaint against Mr. Twersky's client, the owner of a popular Internet website.
In 2007, Mr. Twersky appeared before the Pennsylvania Commonwealth Court on behalf of a Church organization. In that case, he successfully persuaded the appellate court to return control of $100 million in church assets back to his client, thereby reversing the decision of the trial court.
Prior to joining Montgomery McCracken, Mr. Twersky was vice president and general counsel of REON Broadband Corporation, an Internet company located in Massachusetts. He also was a legislative aide to former Pennsylvania State Representative Lita I. Cohen.
Mr. Twersky is admitted to practice in Pennsylvania and New Jersey.
Mr. Twersky received his J.D. degree, magna cum laude, from University of Pittsburgh School of Law in 1997, where he was an editor of the Law Review. He graduated from Boston University with a B.A. degree in 1989.
