Professional Experience:

Timothy J. Bergère is a partner and the chair of the firm's Environmental Law practice group.  Mr. Bergère has been involved in all aspects of environmental counseling and litigation, has served as lead environmental counsel in numerous business, financial and real estate transactions, and has extensive experience in environmental contamination investigation, remediation and Brownfields redevelopment projects.  Prior matters have included the defense of clients in environmental matters involving fires and other thermal events.  His practice concentrates on regulatory compliance matters including Clean Air Act, Clean Water Act, Solid Waste Management Act, RCRA, TSCA, EPCRA, FIFRA, OPA, NEPA, release reporting, Safe Drinking Water Act, DRBC permitting, and coal and non-coal mining, CERCLA/HSCA matters, and complex multi-party allocations.  Mr. Bergère has worked on numerous innovative, insurance-based environmental settlements. Mr. Bergère also represents companies and individuals in civil and criminal enforcement matters under Pennsylvania and federal environmental statutes.

Mr. Bergére's practice includes the analysis and interpretation of laboratory testing, laboratory certification processes, and the review and application of standards and criteria used to establish test methodologies and report valid results.

Mr. Bergère's engagements include representation of a major regional cement manufacturer and a regional foundry in complex Clean Air Act and waste management matters (Title V, NSPS, RACT, MACT, and NSR/PSD); the OPA '90 Responsible Party in connection with NRDA issues arising from the Athos I release to the Delaware River and Bay; a large regional printing/laminating concern in complex Clean Air Act and waste management matters; a quarry operation in permitting and groundwater withdrawal matters, including sinkhole hydrology; public water suppliers in complex groundwater contamination investigations and cost recovery actions, including Federal Facilities impacts; and regional real estate development concerns in site investigation and remediation matters.

Prior to joining the firm in 1988, Mr. Bergère spent five years as an Assistant Counsel and Special Deputy Attorney General with the Pennsylvania Department of Environmental Resources, where he represented the Commonwealth in environmental matters before Pennsylvania and federal courts and administrative agencies.  In that capacity, he counseled the Department's Bureaus of Air Quality Control and Waste Management in a number of criminal enforcement matters and counseled the Bureaus of Air Quality Control, Waste Management, Water Quality Management, Mining & Reclamation and Community Environmental Control in connection with the administration and enforcement of Pennsylvania's environmental programs.

Professional Associations:

In the recent past, Mr. Bergère served as chair of the Environmental, Mineral and Natural Resources Law Section of the Pennsylvania Bar Association (PBA), and as a Section Delegate. He also is a member of Environmental Law Committee of the Philadelphia Bar Association. He is a frequent author and lecturer on topics in environmental law.

His speaking engagements included the Eighth Annual Pennsylvania Environmental Law Forum, sponsored by the Pennsylvania Bar Institute; MTBE and other Environmental Threats to Public Water Supply Systems, Region 1 Chapter of the Pennsylvania Municipal Authorities Association (PMAA), October, 2003; Brownfields Redevelopment: Opportunities Abound- New Developments and Trends, a seminar at MMWR, June 2002; and Managing Significant Civil and Criminal Environmental Investigations from the Perspective of a Private Party,  a graduate course in Law Enforcement at St. Joseph's University, June 2001.

Mr. Bergère received his undergraduate degree in Environmental Studies from New England College and his Juris Doctorate degree from Franklin Pierce Law Center, where he concentrated his studies in the areas of energy and environmental law.
