Special Education Law

Federal and state special education laws entitle children with disabilities to a free and appropriate public education.  This means specially designed instruction that meets the unique needs of a child with a disability, including such developmental, corrective, and other supportive services a child needs to benefit from special education.  The task of designing this type of instruction for a special needs child can seem a daunting task for parents.

  • Consulting with parents about their child's legal rights under federal and state laws;
  • Counseling parents on legal requirements in connection with the development of an Individualized Education Program ("IEP");
  • Advising parents regarding legal options when they cannot come to agreement with a school district on the contents of an IEP;
  • Litigating administrative due process hearings in both Pennsylvania and New Jersey; and
  • Initiating court proceedings, if necessary.
