David F. Herman is an associate in the firm’s Litigation Department where he assists clients in navigating all aspects complex commercial disputes, government investigations and enforcement actions, false claims act litigation, and consumer arbitration matters.

David has litigated matters for clients from initiation through appeal and has significant experience in discovery and discovery disputes.  David has substantial experience in practicing before the Consumer Financial Protection Bureau – advising clients in responding to Bureau investigative requests and defending clients through all phases of the Bureau’s enforcement process.  David also maintains an active consumer arbitration practice and has obtained defense verdicts for his clients in arbitrations actions across the country.

David serves as an editor of the firm’s Data Privacy Alert blog and has presented on issues relating to technology, cybersecurity, and data privacy to attorneys and companies.

Prior to joining Montgomery McCracken, David completed judicial internships with the Honorable Petrese B. Tucker, Chief Judge, U.S. District Court for the Eastern District of Pennsylvania; the Honorable C. Darnell Jones, Judge, U.S. District Court for the Eastern District of Pennsylvania; and the Honorable Arnold L. New, Coordinating Judge, Philadelphia Court of Common Pleas Complex Litigation Program.

David is admitted to practice in Pennsylvania, New Jersey, the United States District Court for the Eastern District of Pennsylvania, the United States District Court for the District of New Jersey, the United States Court of Appeals for the Second Circuit, and the United States Court of Appeals for the Third Circuit.

Academic Achievements

David graduated, magna cum laude, from Temple University’s James E. Beasley School of Law in 2014. He was a member of the Order of the Coif, president of the Student Bar Association, a member of Moot Court Honor Society and a fellow of Rubin Public Interest Law Honor Society. David also served as a teaching assistant and served as the student organizer and author for the American Bar Association’s Third Circuit Media Project.  He was a recipient of the Ben Levy Scholarship and of the Albert M. Cohen Memorial Award. David received a B.A. in History in 2008 from Franklin and Marshall College.
