Davis Lee Wright is a member of the firm’s Creditors’ Rights and Bankruptcy and Maritime and Transportation practice groups with experience in corporate restructurings and maritime bankruptcies. He has represented secured and unsecured creditors, creditors’ committees, committee members, trustees and debtors in numerous proceedings under Chapter 7, 11, and 15 of the Bankruptcy Code.

In addition, he has represented public and private companies in all aspects of their restructuring efforts, including out-of-court work-outs, “prepackaged” bankruptcies, and traditional reorganizations. He routinely counsels clients on the potential impact another entity’s insolvency or bankruptcy may have on business relationships, prospective and existing contracts and agreements, and bankruptcy-specific litigation. Recently, Davis was lead counsel to one of the world’s largest marine fuel suppliers in connection with its bankruptcy proceedings and related litigation, and represented several clients in other maritime-related bankruptcies pending throughout the country.

Prior to joining Montgomery McCracken, Davis was associated with Skadden, Arps, Slate, Meagher & Flom LLP, where his practice focused primarily on complex bankruptcy and commercial litigation matters. Davis previously served as a law clerk to the Honorable Peter J. Walsh, former Chief Judge of the United States Bankruptcy Court for the District of Delaware, and as a legal extern to the Honorable Joseph J. Farnan, Jr., former Judge of the United States District Court for the District of Delaware.

  • Counsel to a foreign representative in its sale of U.S. real property (In re Hanjin Shipping Co., Ltd.), a domestic marine scrap company purchasing vessel assets (In re Offshore Specialty Fabricators, LLC), a Chinese shipyard with an executory shipbuilding contract and its duties, obligations, risks, and potential recovery scenarios (In re Toisa Limited), and a former executive of a maritime transportation company (In re TrailerBridge, Inc.).
  • Counsel to the Debtors in In re O.W. Bunker Holding North America Inc. in connection with confirmation of their Chapter 11 liquidation plan and counsel to the O.W. Bunker USA Inc. Liquidating Trust in various post-confirmation maritime litigation proceedings and related appeals, turnover and collection actions, and claims allowance litigations.
  • Counsel to the Official Committee of Asbestos Claimants of Bestwall LLC (a successor-in-interest to Georgia-Pacific LLC).
  • Co-counsel and Special Counsel to the “E-side” Official Committee of Unsecured Creditors of Energy Future Holdings in its pending Chapter 11 case.
  • Counsel to the Official Committee of Asbestos Personal Injury Claimants in In re Specialty Products Holding Corp.
  • Counsel to a secured lender (In re Weinstein Company Holdings LLC), a national commercial real estate company (In re Lyneil Mitchell Physical Therapy PC), a private university (In re ConnectEdu, Inc.), a leading national CPA firm (In re MF Global Holdings Ltd.), a mechanics’ lien holder (In re Newbury Common Associates LLC), and a product supplier (In re SRC Liquidation, LLC), in connection with contract and lease rejections, the claims allowance process, or the defense of alleged preferential or fraudulent transfers.
  • Special litigation counsel to a large, U.S.-based semiconductor manufacturer in connection with a $450 million administrative expense proceeding involving complex cross-border financial issues relating to a manufacturing foundry agreement.
  • Counsel to a potential acquirer of an oil and natural gas transporter in connection with the development of a competing plan for reorganization and related litigation.
  • Counsel to the largest ethanol producer in the U.S. in connection with its chapter 11 proceeding and related claims allowance and administrative expense litigation.
  • Counsel to a private equity firm in a $5 million preference and fraudulent transfer which resulted in a directed verdict for the client.

Community Involvement

Davis presently serves as a national officer and a member of the Board of Trustees and the Executive Committee of the National Society of the Sons of the American Revolution.  He is registered as a Unit Commissioner with the Del-Mar-Va Council, Boy Scouts of America and active with The American Legion, Department of Delaware.

Davis is active in pro bono matters, advising directors and officers of several Delaware nonprofit entities with regard to fiduciary obligations and corporate governance requirements and serving as a Child’s Attorney for dependent and neglected children in Delaware.

Academic Achievements

Davis received a J.D. degree, magna cum laude, from Villanova University School of Law. While at Villanova Law, he was a managing editor for the Villanova Law Review. Davis also holds a M.B.A. degree from Villanova University and a B.S. degree in Business Administration with a concentration in Accounting from Millersville University of Pennsylvania.
