Michael C. Witsch concentrates on complex commercial litigation, government investigations, and white collar criminal defense. He represents individuals and corporate entities in all phases of civil and criminal litigation, including internal investigations. He is also an appellate attorney with extensive experience briefing and arguing often complex and novel issues on appeal.

Prior to joining Montgomery McCracken, Michael was an assistant district attorney in Philadelphia. As an appellate prosecutor, he served as lead counsel on behalf of the government in securing hundreds of successful appellate results in the Pennsylvania Superior, Commonwealth, and Supreme Courts, and presented oral argument in dozens of those cases. In addition, Michael participated in the investigation and prosecution of sensitive grand jury matters. He also often represented the District Attorney’s Office in civil matters, including complex civil-rights litigation, professional discipline proceedings, and media law disputes.

Michael serves as an editor of the firm’s White Collar Alert blog, which focuses on government investigations and white collar crime.

Community Involvement

Michael serves in leadership positions for several community organizations. Among them, he is Co-President of the College of the Holy Cross Alumni Association Philadelphia Chapter. He is also actively involved in the Philadelphia legal community, particularly the Philadelphia Bar Association, in which he previously served as a member of the Executive Committee of its Young Lawyers Division, and remains a member of its Appellate Courts Committee, and an Investigator on the Commission on Judicial Selection and Retention, which vets the qualifications of state and local judicial candidates.

Michael is also active in local politics and serves as a Committeeperson for the 15th Ward Democratic Executive Committee, which represents the Fairmount neighborhood of Philadelphia.

Academic Achievements

Michael is a cum laude graduate of the Temple University James E. Beasley School of Law. While in law school, he was Lead Research Editor of the Temple International and Comparative Law Journal, a member of Temple Moot Court Honor Society, and a fellow in the Rubin Public Interest Law Society. In his final year, he completed the law school’s year-long Federal Judicial Clerkship Honors Clinical with the Honorable Timothy J. Savage of the U.S. District Court for the Eastern District of Pennsylvania. He also served as a research assistant to Professor Margaret deGuzman, and received the law school’s Lynne M. Abraham Award for outstanding performance in criminal law and professional responsibility courses.

He earned an A.B., cum laude, from the College of the Holy Cross.
