Renee Nunley Smith is a partner in Montgomery McCracken’s Labor and Employment Department, Co-Chair of the firm’s Higher Education Practice Group, Co-Chair of the firm’s Diversity Committee, and a member of the Management Committee. Renee represents national, regional, and local business entities and institutions of higher education in civil rights and employment matters involving claims under federal and state law. She has extensive experience conducting internal investigations, including in matters where harassment and other forms of discrimination are at issue.

Renee’s experience with discrimination matters for educational institutions includes Title IX compliance and response, compliance reviews, investigation of complaints, issuance of investigation reports, and responses to information requests from the U.S. Department of Education.

Renee frequently represents employers before federal and state courts and before administrative agencies on matters involving harassment, discrimination, whistleblower and retaliation, wage and hour, breach of contract, and wrongful termination claims. Renee is also experienced in counseling clients on a variety of workplace issues, including employee hiring, performance management and termination, reductions in force, creating and implementing policies, and drafting various employment agreements.

Renee also counsels public and private clients on traditional labor issues and represents employers in labor negotiations and arbitrations.

Prior to joining Montgomery McCracken, Renee was an attorney at a large national law firm, where she focused on all labor and employment issues. In addition to her career as a practicing attorney, Renee is the founding principal of a real estate development company where she directed and oversaw single and multifamily housing acquisition and development.

  • Defended large transit provider against claims of employment discrimination in federal court
  • Represented gaming industry client against claims of discrimination in federal court and before administrative agencies
  • Defended supermarket chain against age discrimination claim in state court
  • Provided management training to global food company employees on avoiding sexual harassment, discrimination, and retaliation in the workplace

Pro Bono Experience

  • Renee has provided pro bono legal counsel to various organizations, including Wills for Heroes and the Homeless Advocacy Project (HAP).
