The Eagles are back in the big game – don’t get sued over it

The two-week period between the National Football League® (“NFL”) Conference Championship games and the Super Bowl® always results in two things – local businesses seeking to capitalize on one of the most popular sporting events of the year, and the NFL ordering them to stop doing so.

As you most likely have heard by now, either from being a die-hard fan or from the spontaneous “E-A-G-L-E-S EAGLES!” chants that have occurred throughout the city since the team’s win on Sunday, January 21, 2018, the Philadelphia Eagles are heading to Minneapolis (sorry again, Vikings fans) to play in the Super Bowl against the New England Patriots; a rematch of the 2004 Super Bowl, hopefully resulting in a win for the City of Philadelphia both in terms of the game itself and a boost in revenue for local businesses.

 While the Super Bowl brings opportunities to local businesses, they should be sure to keep in mind that the NFL is very protective of its trademarks and is notoriously litigious. So what does this mean for those who want to capitalize on what is likely to be hundreds of thousands of individuals parading around the city in green this Sunday? It means that business owners should be conscious of how to promote their products and events relating to The Big Game.
