FTC Opinion Is a Virtual Primer on Food and Supplement Health Claims

The Federal Trade Commission’s opinion earlier this year in In the Matter of POM Wonderful emphasizes the importance of food and dietary supplement manufacturers and marketers paying close attention to whether their products’ claims of health benefits are permitted by the FTC and backed by sufficient scientific support.
The POM opinion highlights the risks of explicitly or impliedly making a claim that a food or dietary supplement can treat, prevent or reduce the risk of a particular disease or that such health benefits are established by clinical studies in the absence of sufficient scientific support.
