SUMMARY:eDiscovery Cost-Shifting & Taxation of Costs
DESCRIPTION:Partner John G. Papianou will serve as a panelist for CDS’s seminar on eDiscovery Cost-Shifting & Taxation of Costs.The panelists will give a critical examination of the current status of the law with regards to cost-shifting and taxation in the context of eDiscovery. Participants will explore the “American Rule” and how FRCP 26(b)(2)(B) creates an “undue burden or cost” exception to that rule when electronically stored information is concerned. Participants will learn about cost-shifting mechanisms under FRCP 26 and FRCP 37\, common law approaches to cost-shifting and the interplay between FRCP 54(d) and 28 U.S.C. §1920. Participants will compare traditional categories of taxable costs with those costs typically associated with eDiscovery projects. The panel will discuss the impact of opinions from Race Tires America\, Inc. v. Hoosier Racing Tire Corp. through the recent Supreme Court opinion in Taniguchi v. Kan Pacific Saipan\, Ltd. The course will also explore cost-shifting with regards to party agreements\, third parties\, data hosting\, class actions and technology assisted review using recent opinions as case studies.
