SUMMARY:A CYBERATTACK: Can it Cause an Oil Spill? It's Not Just an IT Issue
DESCRIPTION:Can a ship be hacked? Can a vessel’s navigation systems or propulsion be the victims of a cyberattack? Can a pipeline\, refinery\, or offshore platform Operational Technology (OT) environment be attacked with intent to cause an environmental release or create a safety hazard for the people living or working in proximity? Has this already happened? \nMost are aware of the very real risk and capability for an attack on the IT enterprise systems of a company. Our panel of experts will raise awareness as to the risk to the environment and the very real possibility of a cyberattack impacting OT systems to cause an oil spill. \nWhen OPA 90 was first enacted\, Congress\, industry and regulatory agencies envisioned the impetus for an oil spill to come from mechanical failure\, human error\, or natural disaster\, not the deliberate hack of an OT or Industrial Control System (ICS). But\, in today’s world\, this is a very real risk\, depending upon the level of prevention\, preparedness and response capability the operator has invested into their systems. \nThe OPA 90 Forum invites you to join a panel of experts as we explore the real possibility of an oil spill caused by a cyberattack. Such a possibility was not envisioned at the enactment of OPA 90. The Forum is hosting this event to raise awareness of these risks and the importance of their mitigation. \nAdmiral Thad Allen\, 23rd Commandant of the US Coast Guard\, will offer opening remarks and moderate this 90-minute discussion. Admiral Allen will be joined by the following individuals. \n\n\nRear Admiral John Mauger\, Assistant Commandant for Prevention Policy\, US Coast Guard\nKyle Miller\, Principle/Director\, Booz Allen Hamilton Operational Technology (OT) Cybersecurity Practice for Global Commercial\nZachary Tudor\, Associate Laboratory Director\, National and Homeland Security Idaho National Laboratory’s National and Homeland Security Science and Technology Directorate\n\nFor questions\, please contact Alfred J. Kuffler. \nWatch a recording of this event HERE \nAbout OPA 90 Forum \nThe mission of the Forum is to provide a forum for those concerned with OPA 90 preparedness\, prevention\, and response to identify issues\, with the goal of reducing the number and severity of incidents and increasing the effectiveness of response. SUMMARY:The Nuts & Bolts of a Chapter 11 Plan
DESCRIPTION:Edward L. Schnitzer will be a speaker at the Financial Poise™ and West LegalEdCenter™ live webinar titled\, “The Nuts & Bolts of a Chapter 11 Plan.” \nUnderstanding the nuts and bolts of a Chapter 11 plan is essential to understanding Chapter 11 as a whole.  Concepts that permeate any Chapter 11 bankruptcy case (including the Bankruptcy Code’s priority scheme\, proofs of claim\, the concepts of claim allowance and claim reconciliation) cannot be fully understood without reference to the crucible that is a Chapter 11 plan. This webinar will explore the basic elements of a Chapter 11 plan\, how a plan proponent (usually but not always the debtor) seeks to confirm a plan\, and how objectors can try to defeat confirmation. \nClick here for an on-demand version of this webinar

SUMMARY:The Nuts & Bolts of a Lift Stay Motion
DESCRIPTION:Edward L. Schnitzer will be a speaker at the Financial Poise™ and West LegalEdCenter™ live webinar titled\, “The Nuts & Bolts of a Lift Stay Motion.” \nMost businesses of any meaningful size in the United States have a line of credit or term loan with a bank or other lender that is secured by a lien on substantially all of the assets of that business. One of the strongest tools in a secured lender’s toolbox is the ability to ask the bankruptcy court to lift or modify the automatic stay to allow the secured lender to get to its collateral. Needless to say\, the debtor will often oppose the lender’s request. This is just one of many aspects of litigation surrounding the automatic stay. The bankruptcy code provides for specific circumstances under which relief from the stay is permitted\, and litigation over whether the requisite conditions exist is common. This webinar discusses the scope of the automatic stay and the procedure and grounds for seeking relief. \nClick here for more information or to register
