SUMMARY:The Supreme Court’s Decision on the Affordable Care Act Seminar
DESCRIPTION:Montgomery McCracken senior counsel\, Gregory M. Harvey\, is a faculty member for the Pennsylvania’s Bar Institute’s “The Supreme Court’s Decision on the Affordable Care Act” seminar and webcast.\n \n\nThe Case\n \n\nOn March 26th\, 27th and 28th The United States Supreme Court heard arguments in one of the most significant cases to come before the court in decades. In Department of Health and Human Services\, et al. v. Florida\, et al. the Courtaddressed challenges to the constitutionality of the Patient Protection and Affordable Care Act (“ACA”) on various grounds. The Court scheduled an almost unprecedented six hours of oral argument and reviewed over 130 amicus briefs filed in advance. Not since the Court’s deliberations in 1966 over the Voting Rights Act has an issue been granted this much time before the nation’s highest court. The decision will makeconstitutional law history and will fundamentally affect not only how healthcare is provided to Americans but also will determine the scope and breadth of the federal government’s powers under the U.S. Constitution for generations.\n \n\nA decision in the case is expected to be handed down in late June of this year. What will that decision say and how will it affect individuals\, healthcare providers\, and businesses in the U.S.? The Court will address four fundamental questions:\n \n\nIs the Anti-Injunction Act applicable to ACA? Conaty has had several speaking engagements regarding injury-reporting from the players’ perspective and other legal matters confronted by athletic professionals. Prior to his legal career\, Conaty played professional football for 9 years with several NFL teams.\n \n\nPachman is a partner in the firm’s Litigation Department.
