SUMMARY:The Supreme Court’s Decision on the Affordable Care Act Seminar
DESCRIPTION:Montgomery McCracken senior counsel\, Gregory M. Harvey\, is a faculty member for the Pennsylvania’s Bar Institute’s “The Supreme Court’s Decision on the Affordable Care Act” seminar and webcast.\n \n\nThe Case\n \n\nOn March 26th\, 27th and 28th The United States Supreme Court heard arguments in one of the most significant cases to come before the court in decades. In Department of Health and Human Services\, et al. v. Florida\, et al. the Courtaddressed challenges to the constitutionality of the Patient Protection and Affordable Care Act (“ACA”) on various grounds. The Court scheduled an almost unprecedented six hours of oral argument and reviewed over 130 amicus briefs filed in advance. Not since the Court’s deliberations in 1966 over the Voting Rights Act has an issue been granted this much time before the nation’s highest court. The decision will makeconstitutional law history and will fundamentally affect not only how healthcare is provided to Americans but also will determine the scope and breadth of the federal government’s powers under the U.S. Constitution for generations.\n \n\nA decision in the case is expected to be handed down in late June of this year. What will that decision say and how will it affect individuals\, healthcare providers\, and businesses in the U.S.? The Court will address four fundamental questions:\n \n\nIs the Anti-Injunction Act applicable to ACA? If the Court does get beyond this procedural issue then\nIs the ‘individual mandate’ requiring each eligible person in the U.S. to purchase health insurance constitutional? \nIf the individual mandate is ruled unconstitutional does that invalidate the rest of ACA? \nAnd\, lastly\, can the federal government require states to expand their Medicaid programs to comply with greatly expanded thresholds and rules established by ACA? \n\n\nThe Decision \n \n\nOn July 12\, 2012 a panel of prominent healthcare andconstitutional lawyers\, a legal journalist and insurance expert will analyze the decision and discuss the impact it will have on constitutional law\, and how healthcare will be delivered and financed in America.\n \n\n————————————————————————————————————————————\n \n\n\n\n\n\n\n\n\n\n – Learn the details of the Supreme Court’s decision and how it may impact current health care reform efforts\, providers\, employers and payers.\n \n\n – Examine what this decision may mean for congressional authority\, future reform efforts\, federal-state ‘partnerships’ and the Supreme Court going forward. \n \n\n – Learn what your clients should being doing now. \n \n\n \n \n\nClick here for more information.\n \n\nJuly 12\, 2012 at 1:30 PM – 4:45 PM \n\nThe CLE Conference CenterPhiladelphia\, PA and live webcast

SUMMARY:Litigating Class Actions
DESCRIPTION:Montgomery McCracken partner Charles B. Casper will present “National Class Action Trends – Federal Circuit Class Certification Rulings: Strategies and Arguments for winning or defeating class certifications” at the eighth annual comprehensive conference on Litigating Class Actions presented by Law Seminars International.\n \n\nWho Should Attend\nAttorneys\, business executives\, and consultants involved with class action litigation and government officials involved with parallel investigations\n \n\nWhy You Should Attend\n \n\n2011 and early 2012 have been a remarkable period for development of class action law with the Supreme Court’s decisions in Concepcion and CompuCredit applying great deference to arbitration clauses\, even where the result is to bar class action claims\, and lower courts are developing conflicting interpretations of the impact of these decisions. While these cases\, and the Supreme Court decision in Dukes\, have led some to predict a drastic decline in federal court class actions and a clear shift of such actions to state courts\, the volume of class action filings in both state and federal courts continues to be strong with ultimate outcomes uncertain. Bayer and Halliburton are two other Supreme Court opinions issued in the past year\, as is the 9th circuit’s recent Mazza decision\, further contributing to important legal developments in class action law\, and are viewed by some as signs that class actions are far from extinct.\n \n\nTopics Covered:\n \n\nClass action landscape changes after Dukes v. Wal-Mart \nRecent decisions effects on drafting and enforceability of arbitration agreements \nCalifornia Section 17200 update \nTrends in securities and financial industry class actions \nInternet privacy class actions \nPreparing to file class actions \nBest current strategies and arguments for winning or defeating class certifications \nPost-certification motion issues in class actions \nDealing with parallel government investigations \nDeveloping trial strategies and approaches \nA case study of Washington state consumer protection class action \nWhat defendant’s need to know about new media \nEthical issues \n\n\nMay 14\, 2012 at 8:00 AM – May 15\, 2012 at 5:00 PM \n\nhttp://lawseminars.com/detail.php?SeminarCode=12CLASSWA \nWashington State Convention CenterSeattle\, WA

SUMMARY:2nd Annual eDiscovery for the Life Sciences Industry
DESCRIPTION:Pharma\, biotech\, medical device and diagnostic companies have unique regulatory requirements that impact how they conduct internal investigations caused by regulatory inquires\, litigation\, antitrust and whistleblowers. The industry uses a variety of resources to conduct the investigation\, including internal response teams and outside counsel. With the scope of these investigations often ranging beyond simply reviewing email & created user accounts\, extending to enterprise applications for financial and human resource information\, file-sharers\, document management systems\, collaboration tools and structured databases for sales\, marketing\, research and development and clinical trials\, the manner in which these internal investigations are conducted and the tools used requires a tremendous amount of technology and resources where eDiscovery becomes a central tool and asset. With many organizations facing numerous lawsuits based on patent infringement\, intellectual property protection or any of the myriad number of regulations they are held accountable for\, the use of eDiscovery techniques has become more popular than ever.\n \n\nThroughout the two-day program\, attendees will hear case studies\, panel discussion and informative and solutions-based presentations from in-house counsel\, IT executives\, outside counsel\, judges and vendors. The conference will cover a range of topics that will highlight the common challenges that legal and IT professionals face throughout the eDiscovery process. Among the main concerns are finding strategies to reduce the volume of data involved in preservation\, collection and review and proactively implementing cost-cutting measures. Attendees will also have the opportunity to hear directly from judges across different court circuits about their opinions on eDiscovery solutions that have worked in their courts regarding cost-cutting measures and creating a more efficient eDiscovery process. As with all Q1 conferences\, attendees will also have adequate time for networking and knowledge-sharing.\n \n\nMontgomery McCracken partners Michael B. Hayes and Stephen A. Grossman are part of the panel discussion titled “Promoting Proportionality in High Stakes Litigation and Government Investigations” on the second day of the program.\n \n\nClick here for more information.\n \n\nFebruary 27\, 2012 at 7:30 AM – February 28\, 2012 at 4:00 PM \n\nLoews Hotel Philadelphia\, PA

SUMMARY:ALI-ABA Presents: Representing Non-Profits for Non-Specialists
DESCRIPTION:In structuring nonprofits\, the question often arises: “whose organization is it?” This 2-hour program\, recorded on May 9\, 2011\, seeks to answer this question and more\, particularly for non-specialists. Three practitioners who have worked extensively with nonprofits of all sizes and types discuss the critical issues and potential pitfalls in representing such organizations. They explain the confusing terminology in the field and how to distinguish the various types of nonprofits in order to understand which of the differing state and federal rules apply. \n  \nCo-chaired by Donald Kramer and Karl Emerson of Montgomery McCracken (Philadelphia\, PA)\, this pre-recorded video course covers: \n\nDrafting articles of incorporation and bylaws\, board and volunteer liability\, and the need for insurance.\nRequirements for tax exempt status and filing tax information returns.\nEnforcement of the rules by governmental officials and the media.\nThe “quid pro quo” and substantiation rules in the area of charitable contributions.\nCharitable solicitation registration requirements.\nHandling endowments and fundamental changes (mergers\, acquisitions and dissolutions).\n\nJoining Donald Kramer and Karl Emerson is Virginia Sikes of Montgomery McCracken. Although the panelists work primarily with Pennsylvania state law in their daily practice\, general rules of other states are also referenced\, particularly where they may differ from Pennsylvania law. \n\nJune 23\, 2011 at 1:00 PM – 3:00 PM \n\nVideo Webcast of a Pre-recorded Video with Email Q&A.\nQuestions will be answered within 48 hours.
