DESCRIPTION:Partner John G. Papianou will serve as a panelist for CDS’s seminar on eDiscovery Cost-Shifting & Taxation of Costs.The panelists will give a critical examination of the current status of the law with regards to cost-shifting and taxation in the context of eDiscovery. Participants will explore the “American Rule” and how FRCP 26(b)(2)(B) creates an “undue burden or cost” exception to that rule when electronically stored information is concerned. Participants will learn about cost-shifting mechanisms under FRCP 26 and FRCP 37\, common law approaches to cost-shifting and the interplay between FRCP 54(d) and 28 U.S.C. §1920. Participants will compare traditional categories of taxable costs with those costs typically associated with eDiscovery projects. The panel will discuss the impact of opinions from Race Tires America\, Inc. v. Hoosier Racing Tire Corp. through the recent Supreme Court opinion in Taniguchi v. Kan Pacific Saipan\, Ltd. DESCRIPTION:Partner Ellen Brotman is serving as course planner and chairman Richard Scheff is participating as faculty for the Pennsylvania Bar Institute’s “Defending the White Collar Case.”\n \n\nThe F.B.I. defines white collar crime as “a full range of frauds committed by business and government professionals.” These offenses can range from minor benefits fraud to sophisticated Ponzi schemes\, and include the non-filing taxpayer as well as the complicated tax shelter promotion. While each case requires subject matter expertise\, the successful defense of white collar cases hinges on a combination of skill\, creativity and judgment. These offenses present special challenges: the issues are complex\, the documents are confusing and often voluminous and the press coverage may be helping the prosecutor persuade your jurors before you even get a chance to meet them. The lawyers who regularly handle such cases understand that they involve corporate and individual defendants who are targeted as much for who they are as for what they did and their lives\, careers and corporate existence are on the line.\n \n\nThis program will examine the substantive and procedural nuances of white collar defense.
