Montgomery McCracken’s This Year in Nonprofit Law in its 22nd Year

On November 28, Montgomery McCracken, along with Don Kramer’s Nonprofit Issues® presented the 22nd Annual This Year in Nonprofit Law, a program that has come to be a “must attend” event for decision-makers operating nonprofit organizations.  Lindsay J.K. Nichols of GuideStar USA served as the keynote speaker.  Donald W. Kramer, Virginia P. Sikes, Karl E. Emerson, Catherine H. Gillespie, William L. Kingsbury, R. Monica Hennessy, C. Scott Meyers, John M. Myers and Chastity C. Bruno, all of Montgomery McCracken served as panelists.  In addition to a discussion of new laws impacting Pennsylvania nonprofits, topics included Policies and Procedures to Reduce Child Sexual Abuse, Legal and Practical Issues in Mergers and Acquisitions, Issues in Charitable Giving, Making Diversity Work in the Nonprofit World, and Ethical Issues for Lawyers and Executives.

Don Kramer is the editor and publisher of Don Kramer’s Nonprofit Issues®, a national newsletter of “Nonprofit Law You Need To Know.”  With more than 35 years of experience dealing with the concerns of nonprofit organizations, not only as a lawyer, but also as a teacher, writer, publisher and board member, is considered by many, a leading authority in Pennsylvania nonprofit organization matters.

Virginia Sikes’ practice emphasizes tax controversies, state and local taxation, and tax-exempt organizations, including foundations.   She has served as counsel to other law firms on tax-exempt and state and local tax issues. She lectures frequently on tax-related matters, and particularly on issues related to exempt organizations.

Karl Emerson is a former director of the Pennsylvania Bureau of Charitable Organizations provides legal counsel and advice to nonprofit organizations with respect to charitable fundraising, compliance assessments, and internal investigations for charitable and other tax-exempt organizations.

Catherine Gillespie’s practice focuses on healthcare law, in particular, working with long-term care providers and hospitals, higher education law, and on corporate and tax law issues generally affecting nonprofit and tax-exempt organizations.

William Kingsbury counsels for-profit and non-profit organizations with respect to their general operations, structure and governance and in connection with mergers, acquisitions and other transactions.   He has particular experience representing institutional investors, including endowments and foundations, in connection with all aspects of their investment programs.

Monica Hennessy is the co-chair of the firm’s sustainable business practice and is a member of the labor and employment, ADR and maritime practices.  She speaks frequently on employment-related matters, sustainability and alternative dispute resolution.  She chairs the committee responsible for the firm’s in-house diversity- related programs.

Scott Meyer’s diverse practice includes financial and tax Monte Carlo modeling of sophisticated transactions, domestic asset protection, tax reformation of instruments and transactions, closely held business succession planning, technical support for planned giving departments of major institutions and individual tax planning.

John Myers has over 20 years of experience in complex commercial litigation.  His practice includes labor and higher education matters and his work with a nationally ranked university includes tenured faculty intellectual property disputes and conduct effecting tenure, general liability counsel, ethics, university and student policies, and general employment litigation matters. He has been a front-line participant in large institutional crisis management, both in government and the private sector.

Chastity Bruno advises employers and employees on hiring and job transition matters and employers on preventive practices toward protecting confidential information, including trade secret audits.  She is a member of the firm’s Diversity Committee.
