There are certain issues that regularly confront every lawyer who represents cooperative housing corporations. Issues concerning the use and repairs of terraces are quite common. The question of who is responsible for certain repairs within the apartment is often asked. Recently, two decisions have clarified (at least to a certain degree) the two questions that have haunted attorneys who handle co-op matters: can a board do something about a sponsor who absolutely refuses to sell apartments (the answer now is a definite maybe), and can a co-op bring an action against tenant-shareholders based upon their objectionable behavior without review by a court (again, a definite maybe)
