MANAGING WORKFORCE ISSUES IN A RECESSIONARY ECONOMY

Daniel P. O’Meara, Michael L. Epstein, Janice G. Dubler, and Jennifer T. Nocito, in a panel discussion, will explore issues affecting employers and employees in this challenging economy. This includes layoffs, but also cost-cutting alternatives to layoffs, such as job sharing, reducing wages and hours, and decreasing benefits. The discussion will include pros and cons of different strategies as well as compliance with the Worker Adjustment and Retraining Notification Act (WARN), the Age Discrimination in Employment Act (ADEA), and the Older Workers Benefit Protection Act (OWBPA).

EMPLOYEE FREE CHOICE ACT AND UNION ORGANIZING

Daniel P. O’Meara and Mary E. Cavallaro will examine the Employee Free Choice Act, which establishes an easier way for employees to form, join, or assist labor organizations and provides for mandatory injunctions for unfair labor practices during organizing efforts.

Will this new Act lead union organizers to coerce employees into union membership? Will employee privacy in union votes be comprised? Will this Act result in workers unionizing and demanding more expensive compensation packages, health coverage and pensions?

RECENT DEVELOPMENTS IN DISCRIMINATION LAW: RACE, SEX, NATIONAL ORIGIN, RELIGION, OBESITY AND AGE; AND LEGAL ISSUES IN DIVERSITY

Joyce B. Link, Carmon M. Harvey, Erin Pfeffer, and Adam J. Taliaferro will provide an overview of recent developments and hot topics in employment discrimination case law, including the “do’s and don’ts” of diversity initiatives.

What is “diversity?” Are diversity initiatives legal? What will the Ledbetter Fair Pay Act require?
