The Consumer Fraud Product Labeling Class Action Phenomenon: Labels, Language & Lessons – Now & The Future
April 17, 2013
Kristen Polovoy and Julie Chelius, together with MMWR alum Monica Hennessy will serve as presenters for The Consumer Fraud Product Labeling Class Action Phenomenon: Labels, Language & Lessons – Now & The Future presented by the Camden County Bar Association.
Program Overview
Consumer fraud product labeling class actions have dramatically increased-in fact, more than doubled-in recent years. Counsel for consumer goods companies should know how and why to anticipate product labeling lawsuits. This seminar explores significant issues for companies’ in-house and outside counsel on preparing for and defending these suits, including:
- Defending product labeling consumer fraud lawsuits from both a substantive liability & class certification perspective: puffery, predominance, preemption & more;
- The litigation lightning rods of particular product labeling terms;
- Client counseling issues: insurance, reputational exposure & personal liability;
- The relationship between federal agencies & food labeling class actions: impact of Nutrition Labeling & Education Act & other regulations on food labeling claims; Why the “All Natural” claims just keep on coming;
- Unsubstantiated product health claims: a new target of food labeling class actions;
- Anticipating the next phase of product labeling class actions: GMO’s & beyond;
- Impact of revised Federal Trade Commission’s Guides for the Use of Environmental Marketing Claims or “Green Guides” in a company’s marketing decision-making: What’s in, what’s out, what’s forgotten, and what’s neglected? Why should your clients care?
