Car-Crash-Injuries Suit Father and Son Settles for $1.4 Million

A father and son who allegedly suffered physical and emotional injuries when their car was hit a truck settled with the truck’s owner for $1.4 million in Higginbotham v. Budd Pool Co. Inc.

Alfred Higginbotham and his son Mark were driving on Harrisonville Lake Road near Lincoln Road in Woodstown on May 30, 2009, when the truck, owned Budd Pool Co. Inc. of Woodbury and driven an employee, Anthony Galati, hit the front passenger- side door of their vehicle.

Mark Higginbotham, then 9 years old, allegedly sustained head trauma, brain injury, broken right arm bones, a broken right orbital, a collapsed lung and numerous lacerations. Plaintiff lawyer Robert Greenberg said the youth likely would have died had emergency medical technicians not been nearwhen the accident occurred.

Alfred Higginbotham sustained sprains, but his primary cause of action was a Portee claim, said Greenberg, of Cherry Hill’s Aronberg & Kouser.

The parties agreed to settle in mediation with retired U.S. Magistrate Judge Joel Rosen, now of Montgomery McCracken Walker & Rhoads in Cherry Hill..,
