UPDATE: PA Suspends Certain Medical Marijuana Regulations During COVID-19 Emergency

As an update our previous alert, on March 20, 2020, the Pennsylvania Office of Medical Marijuana temporarily suspended the following statutory and regulatory provisions to further address and improve access issues:
- On-site Pick Up: Dispensary employees are allowed to provide medical marijuana to a cardholder in their vehicle on the dispensary’s property.
- Caregiver Restrictions: Patients are allowed more than one care giver if needed. Background checks on caregiver renewal applications will not be required during this emergency period.
- Remote Consultations: Approved between practitioners and medical marijuana cardholders for renewal certifications only (relaxes in-patient consultation requirement).
- Prescription Limit: Approved practitioners may notate on the patient’s certification to dispense a 90-day supply, instead of only a 30-day supply.
The statutory and regulatory suspensions will remain in place for as long as the Proclamation of Disaster Emergency is in effect.
