Montgomery McCracken Negotiates Settlement Agreement for Client Chunk Bike Polo in Trademark Dispute with Ralph Lauren Corp.

PHILADELPHIA–Montgomery McCracken of counsel Matthew A. Kelly, III, with assistance from partner Michael B. Hayes, assisted client, UK-based FreshSide Ltd., in negotiating a settlement agreement regarding its lifestyle fashion brand Chunk Bike Polo in a trademark infringement lawsuit brought by Ralph Lauren Corp. in the United States District Court for the Southern District of New York. Chunk Bike Polo products are sold at the famous Harrods Department Store in London and the company was featured in Bike Polo exhibitions during the 2012 London Summer Olympics.

According to settlement papers, “the Parties have settled their legal dispute in the United States on mutually agreed terms, which are confidential and which involved no admissions or acknowledgements of liability or wrongdoing or judicial determination of the merits of the Parties’ respective claims.”

The terms of the settlement are confidential, but with the dispute resolved, FreshSide plans to bring its Chunk Bike Polo brand to the United States.

Kelly focuses his practice on intellectual property litigation and counseling, patent and trademark prosecution, complex civil and commercial litigation, licensing and contract negotiation. He is a registered patent attorney with extensive patent, trademark and copyright litigation expertise, including with respect to Markman Hearings, appellate practice and an appeal to the United States Supreme Court.

Hayes, co-chair of the firm’s Electronic Discovery practice, concentrates his practice on commercial litigation and government and corporate investigations with a particular focus in the area of pharmaceuticals and related life sciences. He frequently provides legal knowledge, consultations and recommendations concerning electronic discovery issues.
