Montgomery McCracken Obtains Dismissal of Class Action in Stainless Steel Tubing Lawsuit

Montgomery McCracken is pleased to announce that the U.S. District Court for the Western District of Missouri has granted a motion to dismiss a class action suit against Titeflex Corporation in claims arising out of the sale of a flexible gas piping system known as corrugated stainless steel tubing (“CSST”). The Firm represented Titeflex Corporation.
Plaintiffs alleged that CSST tubing is a defective product and created a risk of fire damage due to lighting strikes. Plaintiffs also claimed that Titeflex was aware of the dangers from these conditions and failed to properly inform the public.
On December 27, 2016, District Court Judge Douglas Harpool ordered that this case be dismissed in its entirety because Plaintiffs failed to show actual harm or injury or one that was “certainly impending.” The court found Plaintiffs’ allegations of harm too speculative to satisfy Article III’s standing requirements.
