Montgomery McCracken announced today that R. Montgomery “Monty” Donaldson has rejoined the firm as a partner in its Litigation Department in the firm’s Wilmington office. Donaldson was formerly with Montgomery McCracken from 2003-2014.

“Monty is a highly-skilled litigator and we are thrilled to welcome him back to the partnership,” said Richard M. Simins, Montgomery McCracken’s Chairman. “He joins a growing number of lawyers whom we have recently welcomed back home to Montgomery McCracken. We are very excited have Monty back with us, especially for the contributions he will make to our Wilmington office and Delaware practice. He will be a valuable asset to our clients and to our firm.”

Donaldson focuses his practice on litigation and risk mitigation counseling, with an emphasis on matters involving complex business transactions, corporate governance, securities, and special proceedings under the Delaware General Corporation Law and alternative entity laws. His clients have included: corporations (private and publicly traded), limited liability companies, partnerships, and liquidating trusts; C-suite executives (including some of the country’s most highly compensated public company officers) and other managers, boards, director committees and their advisors; sophisticated investors, including founders, angels, venture capital and private equity; joint ventures and co-developers; and entrepreneurs and their early-stage enterprises.

Donaldson’s litigation practice also involves an array of commercial matters, including commercial contract (such as co-development, licensing, merger and asset sale agreements), intra-organizational disputes (such as member, partner and shareholder disputes), intellectual property disputes, joint venture disputes and business tort cases. Many of these matters take place in the federal and state courts of Delaware, including the internationally recognized Delaware Court of Chancery. In these and other representations, Donaldson is called upon to serve as primary counsel or as Delaware counsel in coordination with reputable firms located throughout the country and abroad.

Donaldson received his J.D. from Dickinson School of Law where he was Senior Editor of the Dickinson Law Review and a member of the Appellate Moot Court Board. He earned his B.A. degree from Bucknell University.
