Montgomery, McCracken, Walker & Rhoads, LLP partners Michael B. Hayes and Lathrop B. Nelson, III were among the presenters for “Attorney-Client Privilege at Risk in Investigations and Audits, a Strafford Publications, Inc. webinar.  Topics discussed during the presentation included:  who is covered by the privilege and attorney work product protection, how the privilege can be waived, maintaining the confidentiality of sensitive information during internal investigations and audits, and best practices for preserving the privilege and work-product protections.

Hayes is inaugural Co-chair of the firm’s E-Discovery Practice Group and a frequent author and presenter on issues involving the attorney-client privilege and legal ethics.   His practice concentrates on commercial litigation and government and corporate investigations with a particular focus on the life sciences.  He is frequently called upon by clients and colleagues to provide legal expertise, consultation and recommendations concerning electronic discovery issues, including preservation of the privilege in large-scale electronic productions.

Nelson’s practice concentrates on complex commercial litigation, government investigations and white collar crime, and antitrust law.  He has represented clients in federal criminal matters involving antitrust, public corruption, health care fraud, tax fraud, environmental crimes, and other federal offenses.
