Overview
Benjamin Goldman is of counsel in Montgomery McCracken’s Litigation Department, where he focuses on complex litigation in state and federal courts nationwide, particularly multijurisdictional products liability, toxic torts, consumer protection, and sexual misconduct liability matters.
A former solo criminal defense practitioner, Benjamin has taken more than 50 cases to trial and regularly navigates parallel civil and criminal proceedings involving high-stakes allegations, including sexual assault and fraud.

Benjamin Goldman is a member of the firm’s Litigation Department, where he focuses his practice on complex litigation in state and federal courts around the country, with a particular focus on multijurisdictional products liability matters, toxic torts, consumer protection issues, and sexual misconduct liability.
Benjamin has successfully handled both civil and criminal cases involving complex and high-stakes allegations. His experience includes representing clients in matters related to sexual assault, including incidents in institutional settings, as well as fraud cases such as insider bank fraud and disputes over the attempted seizure of cryptocurrency. Skilled at navigating parallel civil and criminal proceedings, Benjamin is committed to protecting his clients' rights. He has taken over 50 cases to trial and secured favorable verdicts.
Before joining Montgomery McCracken, Benjamin was an associate at a large personal injury and medical malpractice law firm. Prior to that, Benjamin established himself with a solo criminal defense practice for over ten years.
Benjamin received his J.D. from the University of Michigan. After becoming an attorney, he pursued and earned an M.A. in political science from the University of Michigan. He earned his B.A. in philosophy from the University of Pennsylvania.

Selected Representations
- Represented a corporate officer who faced civil claims of fraudulent transfer and conspiracy flowing from a complex corporate merger. An aggrieved creditor alleged that both the acquiring and acquired companies were alter egos of the client and that the merger was a pretext to hide assets from the plaintiff. Successfully obtained a voluntary dismissal of all claims after defending the client’s deposition.
- Represented an individual client facing both criminal and civil liability for alleged sexual assault of a patient at a mental health facility. Client had pled guilty and served time before coming to Montgomery McCracken. After the court allowed the client to withdraw his guilty plea, the Philadelphia District Attorney’s office dropped all charges days before jury selection. Following the completion of the plaintiff’s deposition, the plaintiff voluntarily dismissed all civil claims.
- Brought a successful immigration habeas corpus petition in federal court on a pro bono basis, resulting in the release of a client who had spent two years in DHS detention.
